Immersive User Research Participation Terms & Conditions

1. Immersive

We are Immersive Labs Limited, a company incorporated in the United Kingdom, with registration number 10553244 and registered office address at The Programme, All Saints’ St, Bristol, England, BS1 2LZ (we, us, our,Immersive).

2. Introduction

We conduct user research to identify unmet customer needs, evaluate design concepts, and solicit feedback on our Platform and product roadmap.

By confirming your acceptance of these terms and conditions or other wise participating in user research, you acknowledge and agree to the following terms and conditions. If you do not agree to these terms and conditions, please do not accept the invitation or participate in user research for Immersive.

3. User Research Process

We may ask you to participate in user research through one of our communication channels, which will set out the nature of the research and how it will be facilitated. User research is typically facilitated through virtual interviews and surveys.

Virtual Interviews

If you agree to participate in a user research interview:

  • We will direct you to our Google scheduling tool for you to select a time and date to hold the user research interview.
  • Research interviews will be conducted using Google Meet and will typically last approximately 45 minutes. These sessions will relate to your experience(s) using the Immersive One Platform and will be recorded (both video and audio).

Surveys

If you agree to participate in a user research survey:

  • We will send you an email to direct you to our third-party survey platform, SurveyMonkey.
  • Surveys may include open-ended questions, ranking tasks, or multiple-choice questions to gather feedback and opinions.
  • The email we send you may include a deadline for completing the survey. Submissions after this deadline will not be eligible for a reward (if applicable).

4. Rewards

As an incentive for fully participating in user research, we may offer you a reward in the form of a virtual gift card.

Reward Notification and Claiming

If we offer you a reward for participating in user research, we will notify you via email and instruct you to follow a link to the Reachdesk platform, where you can choose your virtual gift card.

You will have 10 days from the date of the email notification to claim your reward.If a reward is not claimed within this 10-day period, it will be forfeited.

Reward Options

You can also choose to donate the cash equivalent of the reward to a charity listed on the Reachdesk platform.

Reward Limitations

Rewards are subject to availability and are non-transferable and non-exchangeable for cash or other forms of credit. There is no cash alternative for a reward.

We shall have no liability if you are unable to accept the reward for any reason, including, without limitation, loss or damage during delivery. If you experience issues with reward delivery, please contact Reachdesk support.

Virtual gift cards are issued by the relevant third-party provider and are subject to their respective terms and conditions. You acknowledge that we have no control over such third-party terms and conditions and will have no liability to you in respect of them.

5. Ownership of Feedback, Ideas, and Intellectual Property Rights

All intellectual property rights in and to the user research, including (but not limited to) any intellectual property rights existing in the feedback, ideas, data, or suggestions you provide during your participation, belong to us absolutely and without restriction. Any materials or content you provide to us for the purpose of participating in user research will become our property upon receipt. You agree to do all acts and execute all documents (including deeds)as may be reasonably required by us to give effect to the transfer of ownership of such rights to us.

6. Personal Data

We will process your personal data for the following purposes related to the Competition and prize fulfilment:

  • User Research Participation. Your name and email address will be used to facilitate your participation in the user research, including scheduling interviews or sharing a link to surveys. We will collect any other personal data you choose to share with us voluntarily during the user research session.
  • Interview Recordings. Video and audio recordings of your user research session will be taken. These recordings are for internal analysis and quality assurance purposes only. Your contact details will be pseudonymised, and your image will be de-identified(e.g., by blurring) to the extent practicable for internal use.

  • Survey Responses. We don’t always collect personal data from survey responses, so often we can’t link a survey response back to an identifiable individual. If we do want to link your survey response back to you, we will ask you to provide your name, email address, and the company you work for as questions in the survey.   • Reward Notification and Fulfilment. We will use your name and email address to contact you about your reward. We will also share your name, email address, and delivery address with our third-party partner, Reachdesk, for the sole purpose of reward fulfillment. For further details about how Reachdesk will process your personal data, please read its privacy notice.

6. General

No Obligation to Participate.
Your participation in user research is entirely voluntary.

Amendments:
We reserve the right to amend, suspend, or cancel the user research process or these terms and conditions at any time without prior notice if circumstances beyond our reasonable control make this unavoidable. Any such changes will be posted on our website.

Limitation of Liability.
Insofar as is permitted by law, Immersive will not under any circumstances be responsible or liable to compensate you or accept any liability for any loss occurring because of your participation in user research or taking up of a reward, except where it is caused by the negligence of Immersive, its agents or distributors, or that of their employees. For the avoidance of doubt, nothing in these terms and conditions shall operate to exclude, limit, or restrict your statutory rights.

EntireAgreement:
These terms and conditions constitute the entire agreement between Immersive and you regarding your participation in user research and supersede all prior understandings (whether oral or in writing).


Severability:
Any provision of these terms and conditions found to be illegal, invalid, or unenforceable by any court of competent jurisdiction shall be deemed severed from the remainder of these terms and conditions, which shall continue in full force and effect.

Governing Law and Jurisdiction:
These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts ofEngland and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
